Terms of Service

Please read these Terms of Service carefully before using the TradeFIQ platform. By creating an account or using any part of the Services, you agree to be bound by these Terms.
1. Acceptance of Terms and Eligibility
1.1 Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and TradeFIQ LTD, a company incorporated in England and Wales ("TradeFIQ", "we", "us", or "our"), registered at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, governing your access to and use of the TradeFIQ algorithmic trading platform, website, APIs, mobile applications, and all related services (collectively, the "Services").
By clicking "Create Account", "I Agree", "Sign Up", or by accessing or using the Services in any manner, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must immediately cease using the Services.
1.2 Age Requirement
You must be at least 18 years of age to use the Services. By accepting these Terms, you represent and warrant that you are 18 years of age or older. If you are between 18 and the age of majority in your jurisdiction, you represent that you have the consent of your parent or legal guardian to enter into this agreement. We reserve the right to request proof of age at any time and to terminate accounts of users who do not meet this requirement.
1.3 Restricted Jurisdictions
The Services are not available to individuals or entities located in, incorporated in, or otherwise subject to the laws of jurisdictions that are subject to comprehensive international sanctions, or where the provision of our Services would be unlawful. Restricted jurisdictions currently include:
- Democratic People's Republic of Korea (North Korea)
- Islamic Republic of Iran
- Russian Federation
- Republic of Belarus
- Syrian Arab Republic
- Republic of Cuba
- Bolivarian Republic of Venezuela (to the extent required by applicable sanctions)
- Any other jurisdiction subject to comprehensive trade or financial sanctions imposed by the United Kingdom, the United States, the European Union, or the United Nations.
By using the Services, you represent and warrant that you are not located in, a resident of, or a national or citizen of any Restricted Jurisdiction, and that you are not listed on any sanctions list maintained by the UK, US, EU, or UN. We reserve the right to update this list at any time and to immediately suspend or terminate accounts where sanctions compliance requires it.
1.4 Legal Capacity
You represent that you have the legal capacity to enter into this agreement. If you are using the Services on behalf of a company, organisation, or other legal entity, you represent that you are authorised to bind that entity to these Terms, and all references to "you" and "your" shall refer to that entity.
2. Account Registration and Security
2.1 Account Creation
To access the Services, you must register for an account by providing accurate, current, and complete information as prompted by the registration form. You agree to keep your account information up to date at all times. Providing false, misleading, or fraudulent information is a material breach of these Terms and may result in immediate account termination.
2.2 Account Security and Credentials
You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password and any two-factor authentication (2FA) devices. You must not share your account credentials with any other person. Each registered user must maintain a separate account; account sharing is prohibited.
We strongly recommend that you enable two-factor authentication on your account. TradeFIQ will never ask you for your password via email, chat, or phone.
2.3 Notification of Breach
You must notify us immediately at security@hello.tradefiq.com if you become aware of or reasonably suspect any unauthorised access to or use of your account, or any other breach of security. You are responsible for all activity that occurs under your account prior to such notification and for any activity that occurs due to your failure to maintain the confidentiality of your credentials.
2.4 KYC / Identity Verification
We may require you to complete identity verification (Know Your Customer / KYC) procedures in accordance with applicable anti-money laundering and financial regulations. Failure to satisfactorily complete verification may result in limitations on your account or termination. We process KYC data in accordance with our Privacy Policy.
3. Description of Services
3.1 What TradeFIQ Provides
TradeFIQ is an algorithmic trading technology platform that provides tools enabling users to design, backtest, deploy, and monitor automated trading strategies on third-party financial exchanges. The Services include, but are not limited to: a strategy builder and editor, backtesting engine, live trading execution interface, portfolio analytics dashboard, scheduled strategy runs, copy trading of other users' managed portfolios, and related APIs and developer tools.
3.2 Not Financial Advice
TradeFIQ is a technology platform only. Nothing on the TradeFIQ platform, in our documentation, marketing materials, communications, or the portfolios of managers you may choose to copy constitutes financial advice, investment advice, trading advice, tax advice, or any other form of professional advice. TradeFIQ is not a licensed financial advisor, investment manager, broker, dealer, or financial institution in any jurisdiction.
All trading decisions are made by you, or by automated strategies that you configure and deploy at your sole discretion. You should seek independent financial, legal, and tax advice before making any investment or trading decisions.
3.3 Service Availability
We aim to provide a reliable service but do not guarantee that the Services will be available at all times, uninterrupted, or error-free. We may temporarily suspend access for maintenance, upgrades, emergency security patches, or for reasons beyond our control. We will endeavour to provide advance notice of planned maintenance via our status page or email.
4. Subscription Plans, Payments, and Billing
4.1 Subscription Tiers
TradeFIQ offers both a free tier with limited functionality and paid subscription plans (monthly and annual). Details of features available at each tier are set out on our pricing page, which may be updated from time to time. In the event of a conflict between the pricing page and these Terms, the pricing page at the time of purchase shall prevail for that transaction.
4.2 Free Tier Limitations
The free tier is subject to usage limitations including, without limitation, caps on the number of active strategies, API calls, backtests, and connected exchanges. TradeFIQ reserves the right to modify free tier limitations at any time with reasonable notice.
4.3 Payment
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are stated in United States Dollars (USD) unless otherwise indicated in your billing currency. Card and bank payments are processed by Paystack and Lemon Squeezy; cryptocurrency payments are processed by NowPayments. By providing payment details, you authorise TradeFIQ to charge your payment method, or to accept your cryptocurrency payment, for all applicable fees.
4.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period at the then-current subscription price unless you cancel before the renewal date. You may cancel at any time through your account settings. Cancellation will take effect at the end of the current paid period; you will not be charged for the following period but will retain access until the end of the period for which you have paid.
4.5 Refund Policy
All subscription fees are non-refundable, except where required by applicable law (including statutory consumer rights in the EU, UK, or other jurisdictions that do not permit the exclusion of a cooling-off right). If you cancel during a billing period, no partial or pro-rata refund will be issued for the remaining period unless required by law.
EU and UK consumers who purchase a subscription have a statutory right of withdrawal of 14 days from the date of purchase, provided that you have not already used the Services during that period. By using the Services within the 14-day period, you expressly acknowledge and agree that you waive this right to the extent permitted by law.
4.6 Price Changes
We reserve the right to change our subscription prices. We will provide at least 30 days' prior notice of any price changes via email. If you do not agree to the new prices, you may cancel your subscription before the change takes effect.
4.7 Taxes
Subscription fees shown are exclusive of any applicable taxes (including VAT, GST, sales tax, or withholding taxes). You are responsible for all applicable taxes in your jurisdiction. Where TradeFIQ is legally required to collect taxes on your behalf, these will be added to your invoice.
5. Prohibited Uses
You agree not to use the Services for any unlawful purpose or in any manner that violates these Terms. Without limiting the generality of the foregoing, you specifically agree not to:
- Market manipulation: Use the Services to engage in any form of market manipulation, wash trading, spoofing, layering, front-running, insider trading, or any other practice that is illegal or that violates the terms of service of any connected exchange.
- Money laundering and financial crime: Use the Services in furtherance of money laundering, terrorist financing, fraud, or any other financial crime.
- Automated abuse: Deploy bots, scrapers, or scripts to interact with TradeFIQ's own web interface or APIs in any manner that is excessive, abusive, or causes degradation of service for other users.
- Reselling API access: Resell, sublicense, or otherwise grant third parties access to TradeFIQ's APIs or backend systems without our express written consent.
- Reverse engineering: Decompile, disassemble, reverse engineer, or otherwise attempt to derive source code, algorithms, or trade secrets from the Services.
- Circumventing restrictions: Use technical measures to bypass, disable, or circumvent any security, access control, or usage limitations we have implemented.
- Harmful or disruptive activity: Introduce malicious code, viruses, or harmful data; conduct denial-of-service attacks; or interfere with the integrity or performance of the Services.
- Impersonation: Impersonate TradeFIQ, our employees, or other users, or misrepresent your affiliation with any person or entity.
- Prohibited content: Upload, transmit, or store content that is unlawful, defamatory, obscene, or that infringes intellectual property rights.
Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to appropriate law enforcement or regulatory authorities.
6. Exchange Integrations
6.1 User-Authorised API Access
TradeFIQ integrates with third-party cryptocurrency and financial exchanges ("Exchanges") on your behalf using API credentials that you provide and authorise. By connecting an Exchange to your TradeFIQ account, you authorise TradeFIQ to use your API keys to read account information, fetch market data, place orders, and manage positions, as permitted by the permissions you configure when generating the API keys.
You are responsible for ensuring that the API keys you connect to TradeFIQ are configured with the appropriate permission levels and any withdrawal restrictions that you deem prudent. We recommend you never grant withdrawal permissions to API keys used with TradeFIQ.
6.2 Exchange Risks and TradeFIQ's Liability
Exchanges are independent third-party platforms. TradeFIQ has no control over, and is not responsible for, the availability, security, performance, or policies of any Exchange. TradeFIQ is not liable for:
- Any Exchange downtime, outage, or failure to execute orders;
- Security breaches, hacks, or loss of funds on any Exchange;
- Changes to an Exchange's API, fee structure, margin requirements, or trading rules that affect your strategies;
- Regulatory actions taken against any Exchange, including asset freezes or trading suspensions;
- Any tax consequences of trading activity conducted through the Services.
Your trading capital (the funds used to open and close positions) is held on the Exchange at all times. TradeFIQ never has custody of your trading capital and bears no responsibility for its safekeeping.
This is distinct from your TradeFIQ platform wallet (Section 6A), a separate balance held by TradeFIQ itself for deposits, promotional credits, and managed-portfolio copy fees. TradeFIQ does hold and safeguard platform wallet balances, subject to the withdrawal terms in Section 6A.
6A. Platform Wallet, Withdrawals, and Managed Portfolios (Copy Trading)
6A.1 Platform Wallet
Separately from any Exchange, TradeFIQ maintains an internal ledger ("Platform Wallet") for each user, used for deposits, promotional or bonus credits, discounts, managed-portfolio copy fees, and platform charges. Unlike your trading capital on a connected Exchange, TradeFIQ does hold custody of Platform Wallet balances until you withdraw them. We maintain an immutable, append-only transaction record of all Platform Wallet activity.
Withdrawal requests from your Platform Wallet are subject to identity verification, applicable fees, and processing times disclosed at the time of your request. TradeFIQ may decline or delay a withdrawal where required for fraud prevention, sanctions compliance, or a legal or regulatory obligation.
6A.2 Managed Portfolios (Copy Trading)
TradeFIQ allows eligible users ("Managers") to publish a managed portfolio that other users ("Subscribers") may follow, so that a Subscriber's connected Exchange account automatically mirrors a share of the Manager's trades. Manager eligibility is opt-in and PnL-gated: a Manager must hold an active Premium subscription and demonstrate positive trading performance over a trailing quarter before they may publish a managed portfolio, and their status is re-reviewed every standard calendar quarter. TradeFIQ does not vet, endorse, or guarantee the competence, strategy, or future performance of any Manager. Following a Manager's portfolio carries the same market, strategy, and technology risks described in Section 7, in addition to the risk that the Manager's trading may perform worse than your own independent judgement would have.
A Subscriber's connected Exchange funds are never accessible to the Manager. Mirrored trades are sized as a percentage of the Subscriber's own Exchange balance that the Subscriber configures; the Manager never receives access to, or custody of, a Subscriber's trading capital.
Where a managed portfolio charges a copy fee, that fee is held (not charged) from the Subscriber's Platform Wallet for the relevant period and is only captured (paid to the Manager, less TradeFIQ's platform cut) if that period was profitable for the Subscriber; otherwise the held amount is released back to the Subscriber's available Platform Wallet balance. If a Manager is downgraded (whether by TradeFIQ or because they cease to qualify), their portfolio is unlisted and existing Subscribers are unsubscribed; the Manager's own portfolio and its history are retained, not deleted.
6.3 Exchange Terms
Your use of each Exchange is also subject to that Exchange's own terms of service. You are responsible for complying with the terms of all connected Exchanges, including any restrictions on automated trading.
7. Risk Disclosure: Important
IMPORTANT RISK WARNING: PLEASE READ CAREFULLY
Trading financial instruments, including cryptocurrencies, equities, forex, and derivatives, involves a substantial risk of loss and is not suitable for all investors. Algorithmic trading strategies carry unique additional risks. You should not trade with capital you cannot afford to lose. Past performance of any strategy is not indicative of, nor does it guarantee, future results. By using TradeFIQ, you acknowledge and accept these risks in full.
7.1 Market Risk
Financial markets are inherently volatile. The value of assets can fluctuate significantly and rapidly. Market movements may be driven by macroeconomic events, geopolitical developments, regulatory announcements, or investor sentiment, many of which are unpredictable. You may lose all or a significant portion of your invested capital.
7.2 Algorithmic Strategy Risk
Automated trading strategies, including those deployed through TradeFIQ, may fail to perform as intended due to: software bugs, logical errors in strategy code, unexpected market conditions not accounted for in the strategy's design, or changes in market microstructure. A strategy that performed well historically may perform poorly or cause significant losses in live trading.
Overfitting risk: Strategies that are optimised heavily on historical data ("backtested") may perform significantly worse on live markets because they have been tailored to past conditions that may not recur.
Slippage: The price at which an order is executed may differ from the price at which it was placed, particularly in fast-moving or illiquid markets.
7.3 Technology and Connectivity Risk
Automated strategies depend on continuous internet connectivity, the availability of TradeFIQ's platform, and the availability of the connected Exchange's API. Any interruption (including server outages, network failures, software errors, or Exchange API failures) may result in orders not being placed, modified, or cancelled as intended, potentially causing significant financial losses.
7.4 Leverage Risk
Where strategies use leveraged products (such as margin trading, futures, or perpetual contracts), losses can exceed your initial deposit. Leveraged trading amplifies both gains and losses. You should fully understand the mechanics of any leveraged instrument before trading it with an automated strategy.
7.5 Liquidity Risk
Some assets or markets may have insufficient trading volume to support the execution of orders at a desired price or size. In illiquid conditions, slippage may be severe or orders may not be fillable at all.
7.6 Black Swan Events
Extraordinary, unpredictable events (such as exchange insolvency, regulatory bans, flash crashes, or systemic market failures) may cause losses that no algorithm could have anticipated or mitigated.
7.7 Past Performance Disclaimer
Past performance is not a reliable indicator of future results. Any backtesting results, historical returns, or example strategies shown on the platform are for illustrative purposes only and do not represent actual trading results. Backtested results are inherently limited as they are calculated with the benefit of hindsight and cannot account for real-world factors such as slippage, fees, liquidity constraints, and strategy overfitting.
7.8 No Guarantee of Profit
TradeFIQ makes no representation, warranty, or guarantee that you will make a profit by using the Services. The provision of algorithmic tools does not imply or represent that those tools will generate positive returns for any user.
7.9 Not a Broker or Financial Advisor
TradeFIQ is a software technology company. We are not a broker, dealer, investment manager, financial advisor, fund manager, or regulated financial institution in any jurisdiction. Nothing we provide constitutes or should be construed as financial advice. You bear sole and full responsibility for all trading decisions made through the platform.
We strongly recommend that you seek advice from a qualified, regulated financial advisor before deploying any algorithmic trading strategy with real capital.
8. Intellectual Property
8.1 TradeFIQ's Intellectual Property
The Services, including all software, source code, object code, algorithms, user interfaces, design, graphics, documentation, and any other content or materials provided by TradeFIQ, are owned by or licensed to TradeFIQ LTD and are protected by copyright, trademark, trade secret, and other intellectual property laws in the United Kingdom and internationally.
Subject to your compliance with these Terms and payment of applicable fees, TradeFIQ grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your personal or internal business purposes. This licence does not include the right to sublicense, resell, modify, distribute, or create derivative works from any part of the Services.
The TradeFIQ name, logo, and all related marks are trademarks of TradeFIQ LTD. You may not use these without our prior written permission.
8.2 Your Intellectual Property
You retain all intellectual property rights in any trading strategies, algorithms, or code that you create, upload, or deploy using the Services ("User Strategies"). By creating or uploading User Strategies to the platform, you grant TradeFIQ a limited, non-exclusive licence to host, store, process, and execute your strategies solely for the purpose of providing the Services to you.
You also grant TradeFIQ permission to use aggregated, anonymised, and non-attributable data derived from the execution of User Strategies to improve our services (e.g. identifying common patterns, improving execution infrastructure). We will never share your individual strategy logic, parameters, or performance data with other users without your explicit consent.
8.3 Feedback
If you provide us with feedback, suggestions, or ideas about the Services, you grant TradeFIQ an irrevocable, perpetual, royalty-free licence to use and incorporate such feedback into the Services without any obligation of confidentiality or compensation to you.
9. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree to the collection, use, and sharing of your personal data as described in the Privacy Policy.
10. Termination and Suspension
10.1 Termination by You
You may terminate your account at any time by following the account deletion procedure in your account settings or by contacting us at support@hello.tradefiq.com. Upon termination, your access to paid features will continue until the end of your current paid billing period. No refunds will be issued for the remaining period except as required by law.
10.2 Termination or Suspension by TradeFIQ
TradeFIQ may, in its sole discretion, suspend or terminate your account and access to the Services, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or any applicable law or regulation;
- Suspected fraudulent, abusive, or illegal activity;
- Failure to pay applicable subscription fees;
- Detection that you are located in or a national of a Restricted Jurisdiction;
- Failure to complete required KYC verification;
- Requests from law enforcement, regulatory authorities, or court orders;
- Circumstances where continuation of service would expose TradeFIQ to legal or regulatory risk.
Where feasible and lawful, we will provide reasonable advance notice before suspension or termination. Where immediate action is required (e.g. to prevent fraud or comply with a court order), we may act immediately.
10.3 Effect of Termination
Upon termination, all active strategies deployed through the Services will be halted and all active orders will be cancelled where the Exchange API permits. TradeFIQ is not liable for any losses arising from the cancellation or non-cancellation of orders upon termination. You remain responsible for any open positions on connected Exchanges.
Provisions of these Terms that by their nature should survive termination (including Sections 6A, 7, 8, 11, 12, 13, and 14) shall continue in full force and effect after termination. In particular, your right to withdraw any remaining Platform Wallet balance (Section 6A.1) survives termination, subject to the same verification and compliance checks described there.
11. Limitation of Liability
11.1 Exclusion of Certain Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADEFIQ AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF TRADING CAPITAL, LOSS OF DATA, LOSS OF GOODWILL, COST OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF TRADEFIQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2 Aggregate Liability Cap
To the maximum extent permitted by applicable law, TradeFIQ's total aggregate liability to you for all claims arising out of or in connection with these Terms or the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total subscription fees paid by you to TradeFIQ in the twelve (12) months immediately preceding the event giving rise to the claim.
11.3 Jurisdictional Variations
Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, TradeFIQ's liability will be limited to the fullest extent permitted by applicable law. Nothing in these Terms shall exclude or limit our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be lawfully excluded under applicable consumer protection legislation;
- Rights you have under applicable consumer protection law in your jurisdiction that cannot be contractually waived.
11.4 No Liability for Trading Losses
For the avoidance of doubt, TradeFIQ is not liable for any trading losses, whether direct or indirect, incurred through the use or misuse of the Services, the deployment of any algorithmic strategy, or any failure of the Services to execute orders as expected. All trading and investment decisions are made solely by you.
12. Indemnification
You agree to defend, indemnify, and hold harmless TradeFIQ LTD and its affiliates, and their respective directors, officers, employees, contractors, agents, licensors, and successors (each an "Indemnified Party") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of or inability to use the Services;
- Your violation of these Terms or any applicable law or regulation;
- Your breach of any representation or warranty made in these Terms;
- Any content, strategy, or data you upload, transmit, or deploy through the Services;
- Any dispute between you and any third party, including any Exchange, arising from your use of the Services;
- Any claim by a third party that your User Strategies or your use of the Services infringes their intellectual property rights.
TradeFIQ reserves the right, at its own cost, to assume exclusive control of any matter subject to indemnification by you. You agree to cooperate with our reasonable requests in connection with any such matter.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal dispute proceedings, you agree to first contact us at legal@hello.tradefiq.com and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally. Most concerns can be resolved quickly through direct communication.
13.2 EU and UK Users
If you are a consumer resident in the European Union, you have the right to bring a complaint to your national consumer protection authority or supervisory authority. You may also use the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr. Our email address for ODR purposes is legal@hello.tradefiq.com.
UK consumers have the right to bring proceedings in the English courts and may use the services of the Financial Ombudsman Service where applicable.
13.3 Other Jurisdictions: Binding Arbitration
For users outside the EU and UK (except as prohibited by local law), any dispute, controversy, or claim arising out of or relating to these Terms or the Services that cannot be resolved informally shall be finally resolved by binding arbitration administered by the London Court of International Arbitration (LCIA) under its current Arbitration Rules, which are incorporated by reference into this clause. The seat of arbitration shall be London, England. The language of arbitration shall be English. The arbitral tribunal shall consist of one arbitrator. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver: You agree that any arbitration or dispute proceedings shall be conducted on an individual basis and not in a class, consolidated, or representative form, to the extent permitted by applicable law.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of laws principles. Subject to the arbitration clause in Section 13:
- UK users: The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising under or in connection with these Terms.
- EU users: Nothing in these Terms removes your rights as a consumer under the mandatory consumer protection laws of your country of residence. EU consumers may bring proceedings in the courts of their country of residence.
- US users (business disputes): Business disputes may also be subject to the jurisdiction of the courts of the State of Delaware in the United States, where TradeFIQ may maintain a registered agent for legal process.
- Australian users: To the extent required by the Australian Consumer Law, these Terms do not exclude, restrict, or modify rights you have under that law, including any applicable guarantees.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page;
- Send registered users an email notification at least 30 days before the updated Terms take effect, clearly describing the material changes;
- Display a prominent notice on the platform.

16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, Risk Disclosure, and any other policies or agreements incorporated by reference, constitute the entire agreement between you and TradeFIQ with respect to the Services and supersede all prior agreements and understandings.
16.2 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall remain in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of TradeFIQ.
16.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. TradeFIQ may assign or transfer its rights and obligations under these Terms, in whole or in part, without restriction.
16.5 Force Majeure
TradeFIQ shall not be liable for any failure or delay in performance of the Services resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, government actions, regulatory changes, internet or power outages, cyberattacks, or Exchange failures.
